Device Buyback - Terms & Conditions

General information

Alza.cz, a.s., CIN: 27082440, with headquarters at Jankovcova 1522/53, Holešovice, 170 00 Prague 7, registered with the Municipal Court in Prague under file no. B 8573 (hereinafter referred to as "Alza"), offers a trade-in service called "Device Buyback," under which customers (or their legal successors) may offer certain types of devices previously purchased from Alza for buyback by Alza under the conditions set out below (hereinafter referred to as the "Buyback").

Eligible devices include: phones, tablets, smartwatches, laptops, gaming consoles, camera lenses, and cameras.

Certain terms may appear throughout the following text. If they begin with a capital letter, they have the following meaning:

Customer: A natural person (including a self-employed individual) or a legal entity that has a My Alza account and wishes to sell a device they purchased from Alza;

Buyback Agreement: An agreement between Alza and the Customer under which Alza purchases the eligible device in exchange for the trade-in price. Unless otherwise stated, the legal relationship is governed by the general provisions of Sections 2079 et seq. of the Civil Code;

Buyback Price: The monetary amount paid by Alza under the Buyback Agreement. It consists of the device value and a trade-in bonus, if offered by Alza to the Customer in a specific case.

Buyback process

The Customer submits an offer to conclude a Buyback Agreement by properly completing the form and submitting it by clicking the “Finalise trade-in application” button. Alza will promptly confirm that the Customer’s offer has been successfully received. However, this confirmation does not constitute acceptance of the proposal to conclude the Buyback Agreement.

Based on the information provided by the Customer in the form, a preliminary non-binding trade-in price for the device will be determined. This information is also considered part of the Customer’s offer, and the Customer has no legal entitlement to conclude the Buyback Agreement under the conditions specified in the offer.

Alza will then provide the Customer with information regarding the collection of the device (particularly about reserving an AlzaBox locker). The Customer shall deposit their device in an AlzaBox according to Alza's instructions no later than 20 days from the creation of the buyback request. If the Customer fails to deposit the device within this period, Alza will automatically reject the request. The Customer may then submit a new request, but Alza does not guarantee the original price estimate.

After collection, Alza will determine the actual condition of the device and, based on this assessment, set the final Buyback Price.

If the Buyback Price is determined to be the same as the price estimated when completing the form under section 2.2, Alza accepts the Customer’s offer.

If Alza determines a different Buyback Price than the one provided by the Customer in the form, Alza will send a new price proposal to the Customer for approval as part of a new offer to conclude the Buyback Agreement.

The Buyback Agreement is concluded when:

the Customer receives Alza’s acceptance of the offer to conclude the Buyback Agreement under section 2.4.1; or

the Customer approves Alza’s new price proposal under section 2.4.2. The validity of this proposal is 14 days. If the Customer does not accept it within this period, the agreement is not concluded and Alza will inform the Customer how the device will be returned.

Ownership of the buyback device transfers upon the conclusion of the Buyback Agreement.

The risk of damage to the item transfers:

to Alza at the moment the Customer places the device in the designated AlzaBox locker and closes the locker door; in the case of another delivery method, when the device is handed over to the carrier or an Alza employee;

back to the Customer if the Buyback Agreement is not concluded and the device is returned. This occurs when Alza hands the device over to the Customer or otherwise allows them to take possession of it (e.g. by opening the relevant AlzaBox locker).

In the event the Buyback Price is approved, thereby concluding the Buyback Agreement, Alza will pay the Buyback Price to the bank account provided by the Customer after mutual confirmation of the price. Cash payment is not possible.

How do I prepare my device for trade-in?

Before handing over the device to Alza, the Customer must:

Pack the device according to the instructions available at the link provided;

Restore the device to factory settings and remove all components that are not part of the trade-in. This mainly includes added or replaced RAM modules, hard drives, or SSDs in notebooks and computers. Alza bears no responsibility for such components unless they are explicitly listed in the trade-in form. If the device submitted for trade-in is not in factory configuration and has been modified by or at the request of the Customer, the Customer acknowledges that service intervention by Alza may result in the loss of such modifications without compensation.

When handing over the device, Alza recommends creating appropriate backups of necessary data and preventing their possible misuse or damage. Alza is not responsible for any loss, damage, or misuse of data stored on the devices;

Provide all parts and accessories listed in the form and/or required for proper use of the device, if available.

Alza may reject a Buyback Agreement if:

the device is excessively dirty or does not meet basic hygiene standards;

the existing security settings on the device prevent access. If access to the device is protected by a password, gesture, or other security feature, the Customer is required to disable this protection or provide the password in the description of the issue when submitting a claim. Otherwise, Alza reserves the right to refuse the trade-in. The same applies if the device's BIOS, firmware, or storage access is protected. Without full access to the device, it may not be possible to complete the buyback;

the serial number (or IMEI) is unreadable;

anti-theft features are activated on the device;

the device is still logged into the Customer’s account in any application or function;

the Customer sends a different device type or model than the one specified in the form.

The Customer is also informed that devices submitted for service claims should be in factory configuration. This includes removing any added or replaced RAM, hard drives, or SSDs in notebooks and computers. The seller bears no responsibility for such parts, especially if they are not explicitly listed when the item is received for service. If the Customer submits goods for service that are not in factory configuration, the Customer acknowledges that service intervention may result in the loss of such modifications without compensation.

Customer information

Alza hereby informs the Customer that:

the Agreement may be concluded in Czech. Information about the Buyback Agreement will be made available through the Customer’s My Alza profile. Alza recommends carefully checking all information before submitting a trade-in request, as it may no longer be possible to modify it afterwards;

withdrawal from the Buyback Agreement within the 14-day period is possible via the contact form;

if Alza fails to properly fulfill its obligation under the Buyback Agreement, the Customer is entitled to rights arising from defective performance. The Customer may choose between remedial performance, price adjustment, or withdrawal from the agreement, depending on the nature of the case;

Alza may be contacted with any questions or messages via the contact chat with the virtual assistant Alzee or by phone at +420 225 340 111. Complaints submitted through the form will be handled by a specialised claims team. If the claim is not resolved to the Customer’s satisfaction, disputes may also be resolved out of court. In such cases, the consumer (if the purchase was not made under a business ID) may contact the Czech Trade Inspection Authority or resolve the dispute online via the ODR platform.

In cases where the Customer does not agree with a new price proposal and consequently the Buyback Agreement is not concluded, Alza will return the device to the Customer. The Customer is obliged to take possession of the device without undue delay, within 30 days of being informed by Alza of the return method. If the Customer fails to take possession of the device within this period, a storage fee will be charged after its lapse, amounting to 50 CZK including VAT for each day of delay. If the Customer does not collect the device within 2 months from the day they were informed about the return, Alza reserves the right to sell the device and use the proceeds to cover storage fees.

Buyback from VAT Payers. Alza informs customers who are registered VAT payers that:

the Buyback Price is always displayed including VAT, and it is also paid out including VAT;

invoicing is performed via self-billing, meaning Alza issues the tax document on behalf of the Customer. The Customer is responsible for the accuracy of the VAT ID provided in the trade-in form. The content of the tax document may be disputed via the contact form within five (5) days;

they are obliged to include the tax document in their VAT control statement.

Relationship to other Alza services

AlzaNEO. If the Customer uses the device through the AlzaNEO program, they are not its owner. For this reason, Alza will reject the trade-in request for such a device.

One Third. If the device was purchased through the One Third program, the trade-in can only be processed after full payment. Alza will reject the request if the purchase price has not been fully paid.

Installment purchases. If the Customer paid in installments, the trade-in can only proceed once the consumer credit agreement between the Customer and the credit provider has been confirmed. Alza verifies the existence of this agreement with the credit provider after the trade-in request. If confirmation is not received, the request will be rejected.

Privacy policy

Alza declares that all personal data (in the case of a Business Customer, in particular personal data of the Business Customer’s employees) is confidential and will be used solely for the purpose of fulfilling the Buyback Agreement with the Customer. Personal data is collected, processed, and stored in accordance with applicable laws, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as amended.

Further details on data processing can be found on Alza's privacy policy page.

Final provisions

These terms and any resulting relationships are governed by the laws of the Czech Republic.

If any provision of these Terms becomes invalid, ineffective, or unenforceable, such invalidity, ineffectiveness, or unenforceability shall not affect the validity, effectiveness, or enforceability of the remaining provisions unless otherwise required by law.

Alza is entitled to offset any monetary obligations and claims it has against the Customer, even if they arise from different legal relationships.

Alza reserves the right to amend these Terms at any time. Changes become effective on the date they are published on the alza.cz e-shop unless stated otherwise.

Any disputes arising from the Agreement or membership shall be resolved by the court with jurisdiction over Alza’s registered office.
